These Terms and Conditions govern your use of the actionvault.net website and the booking of heavy haulage and freight services with ActionVault Logistics Pty Ltd. By accessing the website or placing a booking, you agree to these terms. If you do not agree, please do not use the site or our services.
Definitions
"We", "us" and "our" refer to ActionVault Logistics Pty Ltd. "You" and "your" refer to the user of the website or the customer booking transport services. "Freight" means any goods, cargo, pallets, machinery or items transported by us.
Website use
The website is provided for information and quote requests. Content is for general guidance and is not a binding offer. We reserve the right to update, change or remove content at any time without notice. You agree not to use the website for unlawful, fraudulent or disruptive purposes.
Quotes and bookings
- All quotes are estimates and are valid for 14 days unless otherwise stated.
- A booking is confirmed only after we issue a written confirmation and any required deposit is received.
- Rates are based on the weight, dimensions, access, route and timing provided at the time of quoting.
- Changes to freight details may result in a revised price.
Customer responsibilities
You must provide accurate and complete information about the freight, including weight, dimensions, hazardous properties and any loading or unloading restrictions. You must ensure that goods are packaged, labelled and secured appropriately for transport. You are responsible for having the correct permits, export paperwork or customs documentation where required.
Limitation of liability
Our liability for loss or damage to freight is limited to the amount covered by our standard cargo care coverage or any declared-value insurance arranged before dispatch. We are not liable for indirect, consequential or economic loss, including lost profits, production downtime or missed deadlines, except where prohibited by law. We are not liable for delays caused by weather, road closures, strikes, accidents, customs or any other events outside our reasonable control.
Payment terms
Unless agreed otherwise, payment is due within 14 days of invoice. Casual bookings may require pre-payment. Late payments may incur interest and collection costs. We may refuse future bookings until overdue accounts are settled.
Cancellation and rescheduling
Cancellations or reschedules must be provided in writing. Cancellations within 12 hours of the booked pick-up window may incur a cancellation fee. Reschedules are subject to vehicle and driver availability.
Insurance and risk
We carry public liability, motor vehicle and cargo insurance as required for our operations. Customers are encouraged to arrange additional insurance for high-value or fragile goods. Claims for damage or loss must be reported in writing within 48 hours of delivery, along with supporting evidence.
Governing law
These terms are governed by the laws of New South Wales, Australia. Any dispute will first be handled through good-faith negotiation. If a dispute cannot be resolved, it will be submitted to the courts of New South Wales.
Changes to these terms
We may update these Terms and Conditions from time to time. The updated version will be published on this page. Continued use of the website or services after changes are posted means you accept the revised terms.
